General Conditions of Sale (GCS)
Between the company MONA Group, a simplified joint-stock company (SAS), registered with the Paris Trade and Companies Register under SIRET number 987 883 527 00011 , , whose registered office is located at 60 rue François 1er, 75008 Paris, represented by Romdhane Naël as President, duly authorized for the purposes hereof,
hereinafter the “Seller” or the “Company”,
And any natural or legal person purchasing products offered by the nhshop.fr website, hereinafter “the Buyer” or “the Customer”.
It was stated and agreed as follows:
PREAMBLE
The MONA Group company specializes in the online sale of exclusively new clothing, shoes and accessories, aimed at consumers, via its website nhshop.fr .
The list and description of the properties offered can be viewed on the aforementioned website.
Article 1: Purpose and general provisions
These General Conditions of Sale determine the rights and obligations of the parties in the context of the online sale of products offered by the Seller.
The Seller reserves the right to modify these General Terms and Conditions at any time by publishing a new version on its website. The applicable General Terms and Conditions are those in force on the date of the order.
The Client declares that they have read all of these General Terms and Conditions and accept them without reservation. They acknowledge that they have the legal capacity to enter into a contract or validly represent the legal entity they are engaging.
Article 2: Price
Product prices are indicated in euros including all taxes.
They do not include delivery costs, which are specified when the order is confirmed.
When ordering to a country outside the European Union, customs duties or local taxes may apply. These charges are the responsibility of the Customer.
The Seller reserves the right to modify its prices at any time, while guaranteeing the application of the price in effect at the time of the order.
Article 3: Products
The essential characteristics of the products are presented on the nhshop.fr website.
The photographs have no contractual value.
The Seller undertakes to fulfill orders within the limits of available stocks. In the event of unavailability, the Customer will be informed by email and may cancel or modify their order.
Article 4: Retention of title
The products remain the property of the Seller until full payment of the price.
Article 5: Delivery terms
The products are delivered to the address indicated by the Customer at the time of ordering.
Delivery times are given for information purposes only. In the event of a delay, the Customer may request cancellation of the order in accordance with the conditions set out in Article L216-2 of the Consumer Code.
The transfer of risks takes place upon delivery of the package to the Customer.

Article 6: Availability
If a product is unavailable for more than 30 days, the Customer will be informed and may request a full refund or credit for the amount paid.
Article 7: Payment
Payment is due immediately upon ordering.
It is done via bank card or secure service providers (Shopify Payments, Stripe, PayPal).
The Customer guarantees that he or she is the owner of the payment method used. All transactions are secure and encrypted according to current standards.
Article 8: Right of withdrawal
In accordance with Articles L221-18 to L221-28 of the Consumer Code, the Customer has a period of 14 days from receipt of the products to exercise their right of withdrawal, without reason or penalty, except return costs.
Products must be returned in their original condition , unworn, unwashed, in their original packaging;
Reimbursement will be made within a maximum of 14 days after receipt of the products.
Article 9: Legal guarantees
The Seller is responsible for the conformity of the products in accordance with articles L217-4 et seq. of the Consumer Code, and for hidden defects in accordance with articles 1641 et seq. of the Civil Code.

In the event of non-conformity, the Customer may request repair, replacement or reimbursement of the product.
Article 10: Complaints
Any complaint can be sent by email to contact@nhshop.fr or via the contact form on the website nhshop.fr/contact .
Article 11: Intellectual property
All elements of the nhshop.fr website are the exclusive property of MONA Group.
Any total or partial reproduction is prohibited without written authorization.
Article 12: Force majeure
Neither party may be held liable in the event of non-performance of its obligations due to an event of force majeure as defined by French case law.
Article 13: Partial nullity
If a clause of these T&Cs were declared null and void, this would not affect the other clauses which would remain in force.
Article 14: Personal data
The Client is invited to consult the site's Privacy Policy to find out how their data is collected, processed and stored.
In accordance with the Data Protection Act and the GDPR, the Client has the right to access, rectify, oppose and delete their data.
Article 15: Mediation
In accordance with Articles L.616-1 and R.616-1 of the Consumer Code, any unresolved dispute may be submitted free of charge to a consumer mediator.

Article 16: Right to refrain from telephone canvassing
In accordance with Article L223-2 of the Consumer Code, the Customer can register free of charge on the telephone canvassing opposition list via the website: www.bloctel.gouv.fr
Article 17: Applicable law and competent jurisdiction
These T&Cs are subject to French law .
Any dispute not resolved amicably will be submitted to the competent courts within the jurisdiction of the MONA Group head office.
